While NFTs are not explicitly illegal in India, the legal status of NFTs is very vague and falls under a grey area. There are no specific laws that regulate NFTs, however they are regarded as Virtual Digital Assets (VDAs) under the Income Tax Act, and therefore applicable to tax legislation. The Reserve Bank of India (RBI) and the Securities and Exchange Board of India (SEBI) are also tracking the NFT space.
