These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client”, “User”, “Customer”) and:

By accessing, subscribing to, purchasing, or using any services, software, tools, or platforms provided by BANTECH, you agree to these Terms.

2. Services Covered

BANTECH provides IT Services and SaaS-based Software, including but not limited to:

  • Website Design & Development

  • Mobile Application Development

  • Web-based Tools & Custom Software

  • Subscription-based SaaS Platforms

  • Search Engine Optimization (SEO)

  • Support, Maintenance & Managed Services

  • AI-driven & Blockchain-based Solutions

Specific deliverables are governed by written proposals, Statements of Work (SOW), or subscription plans.

3. SaaS Subscriptions & Billing

3.1 Subscription Plans

  • Services may be billed monthly, quarterly, or annually

  • Subscriptions auto-renew unless cancelled

  • Pricing, features, and limits are defined on the purchase page or proposal

3.2 Payment Processing

Payments are processed via PCI-DSS compliant gateways, including:

  • PayPal

  • Razorpay

  • Payoneer

BANTECH does not store card or banking details.

3.3 Taxes

  • Indian customers will be charged GST as applicable

  • International customers are responsible for local taxes, VAT, or withholding, unless stated otherwise

4. Account Responsibility

You agree to:

  • Maintain accurate account information

  • Keep login credentials confidential

  • Accept responsibility for all activity under your account

  • Notify us immediately of unauthorized access

5. Intellectual Property Rights

  • All platforms, SaaS tools, frameworks, codebases, UI/UX, and documentation remain the intellectual property of BANTECH unless explicitly transferred in writing.

  • Subscription grants a limited, non-exclusive, non-transferable license to use the software.

  • Reverse engineering, resale, sublicensing, or copying is prohibited.

6. Acceptable Use Policy

Users shall NOT:

  • Use services for unlawful or fraudulent purposes

  • Upload malicious code, malware, or abusive content

  • Attempt unauthorized access to systems

  • Violate intellectual property or data protection laws

Violation may result in immediate termination.

7. Service Availability & Support

  • SaaS uptime targets may be defined but are not guaranteed

  • Maintenance windows may occur without liability

  • Support response times depend on plan tier

8. Confidentiality

Each party agrees to protect confidential and proprietary information disclosed during the engagement, except where disclosure is required by law.

9. Limitation of Liability

To the maximum extent permitted by law:

  • BANTECH shall not be liable for indirect, incidental, special, or consequential damages

  • Total liability shall not exceed the fees paid by the customer in the preceding 6 months

10. Indemnification

You agree to indemnify and hold harmless BANTECH and its partners, officers, and employees from claims arising from:

  • Your misuse of services

  • Violation of laws or third-party rights

  • Data or content provided by you

11. Termination

We may suspend or terminate services for:

  • Breach of Terms

  • Non-payment

  • Illegal or abusive usage

Outstanding dues remain payable upon termination.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Kolkata, West Bengal, shall have exclusive jurisdiction.
